Sierra Star Reviews offers an automated platform for businesses to request customer reviews via SMS and email. We facilitate the sending of review requests, but we do not generate reviews, alter feedback, or guarantee positive reviews. Our services are designed to improve the review acquisition process and provide businesses with valuable customer feedback.

3. Business Obligations

Businesses utilizing our services must:

Obtain Consent:Ensure that they have obtained explicit consent from customers before providing their contact details for review requests. Failure to do so may result in the termination of services.

Compliance with Laws:Businesses must comply with all applicable laws and regulations, including the TCPA, CAN-SPAM, and GDPR, as well as local, state, and international data privacy laws. Non-compliance could result in suspension or termination of services.

Accuracy of Data:Businesses must provide accurate and truthful customer data. The submission of incorrect, false, or misleading data will result in termination of the services and potential legal action.

4. Limitation of Liability

The Company’s liability for any claim arising from the use of our services is limited to the amount paid by the business for the service during the 12-month period prior to the claim.

We are not liable for:

Any legal consequences that arise from a business’s failure to obtain consent from its customers.The failure of SMS or email messages to reach the intended recipients due to technical or delivery issues.Any fines or penalties imposed on businesses for non-compliance with regulatory or legal requirements.

5. Indemnification

Businesses agree to indemnify, defend, and hold harmless Sierra Star Reviews, its affiliates, officers, employees, agents, and partners from and against any and all claims, damages, losses, liabilities, and expenses, including attorney fees, arising from:

Violations of privacy laws, including but not limited to the TCPA, GDPR, and CAN-SPAM.Unauthorized use of customer data.Misuse of the platform or services that leads to legal or financial consequences.

6. Termination of Services

We reserve the right to suspend or terminate services for any business that violates these Terms & Conditions, including non-compliance with legal obligations or providing inaccurate data. Businesses can terminate their relationship with us at any time by providing written notice.

7. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of Nevada. Any legal disputes arising from these Terms & Conditions will be resolved in the competent courts of Nevada.
